The former Blair student accused of stabbing two freshmen last May will be charged as a juvenile in his upcoming trial.
The suspect, David Ernest Dominguez, was indicted as an adult and charged with first degree attempted murder and two counts of first degree assault. However at a waiver hearing two weeks ago, the judge changed the charges to those of a juvenile.
According to the States' Attorney Office, the goal of the Department of Juvenile Justice is to correct the offender and "send a clear message that juvenile offenders will be held accountable for their actions and appropriately sanctioned for their conduct."
However, according to Assistant State Attorney and prosecutor of gang offenses Jeffery Wennar, Dominguez will not benefit from being prosecuted as a juvenile. "Juvenile Justice claims they have programs, when in fact they don't," Wennar said.
As a juvenile, Dominguez "will be out of jail in 15 months and will not be any different," says Wenner.
The stabbing incident began as a fight between two freshmen and the two suspects during lunch on May 31 near Marvin Memorial Methodist Church. The stabbing occurred later at the corner of Lexington Drive and Pierce Drive.
According to Assistant Principal Pat Hurley, the victims no longer attend Blair, but are "receiving an education in MCPS."
